Scope of application

These Terms of Use for electronic online services (“Terms of Use”) apply to the electronic online services provided by Tampereen Sähkölaitos Oy and its subsidiaries Tampereen Sähköverkko Oy, Tampereen Vera Oy and Tammervoima Oy (hereinafter collectively “Tampereen Sähkölaitos”) and all use of the content and materials available through them, unless otherwise specifically stated or agreed.

The user of the Service (“User”) must carefully study these Terms of Use before using the Service. Using the Service is not permitted if the User does not accept these Terms of Use. Starting to use the service is also considered as accepting the Terms of Use.

The Service

Online services refer to all electronically available online services provided by Tampereen Sähkölaitos, such as energy use reporting services, user data and contract management services, online services related to consumer and corporate customer transactions and all materials and other content provided through them and their use (“Service”). The services may be provided for use either through an Internet browser or as a mobile service.

Tampereen Sähkölaitos is constantly developing the Service. As a result of continuous development work, Tampereen Sähkölaitos reserves the right to modify the Service and its contents as part of its development work. Changes, additions and deletions to the content and features of the Service may be made at any time without notice, or production of the Service may be discontinued entirely.

Service deployment and registration

Using the service requires the User to have the necessary data communication connections and an Internet browser or a mobile application. By default, using the Services requires registration, but certain Services may also be available without registration. The registration requirement will be specified separately for each Service, if necessary.

If using the Service requires registration, the User becomes a user of the Service on the web site or in the mobile application and accepts these Terms of Use or any terms and conditions for a particular separate service as binding on him or her. The deployment of the service may require the User to provide certain information during registration for purposes such as verification of the User's identity. During registration, the User chooses a username and password for using the Service. When logging in to the Service for the first time, registration may require strong electronic identification from the User, depending on the content of the Service.

Contents of the Service

The Service is provided "as is" without warranty of any kind. Tampereen Sähkölaitos shall not be responsible for the validity, accuracy or completeness of the data or materials in the Service in any part or manner.

For clarification, it is stated that the materials presented in the Service shall not serve as a basis for invoicing and cannot be used for making claims related to invoicing or its correction. The user should note that the energy consumption data in the Service may contain some discrepancies with actual energy consumption. This is due, among other things, to the technical challenges of hourly data transfer (e.g. disruptions in data transfer). User invoicing, on the other hand, is naturally always based on actual energy consumption, and any aforementioned technical problems with data transfer shall not affect the reliability of invoicing.

Service availability

Tampereen Sähkölaitos strives to ensure the usability of the Service continuously and without interruptions. However, Tampereen Sähkölaitos shall not be liable for the uninterrupted, error-free or timely operation of the Service or for any technical defects, interruptions caused by maintenance or installation operations, change or loss of data or problems, malfunctions or interruptions in data transfer caused by third parties or damages to Users resulting from them.

Tampereen Sähkölaitos strives to inform Users of possible disruptions in the service and to make the Service available again within a reasonable time after receiving notification about the disruption. The User may report any disruptions or malfunctions in the Service by contacting Tampereen Sähkölaitos' customer service at asiakaspalvelu@sahkolaitos.fi.

Tampereen Sähkölaitos has the right to restrict the use of the Service or its features and to block the User's access to the Service for a justified reason at any time. Tampereen Sähkölaitos may exercise the aforementioned rights without prior notice and without liability. Tampereen Sähkölaitos also reserves the right to invoke all of its legal rights arising from a violation of the restrictions specified in these Terms of Use.

User's rights and restrictions regarding the use of the service

Tampereen Sähkölaitos grants the User a limited, non-exclusive, non-transferable right to use the Service as defined in these Terms of Use; for a consumer user, only for the User's personal use, and for a community user, only for intra-community use, and the User may not use the Service for commercial purposes, in whole or in part.

The Service may only be used in accordance with the currently valid Terms of Use and applicable legislation, as well as any instructions and conditions provided separately in the Service.

The User has a right to view and browse the Service and its content (hereinafter “Content”) and to use the features included in the Service. The User may not modify or reproduce the Service or Content in any way or distribute, share, transmit, publicly present or otherwise publish the Service or Content in whole or in part. The structure and technical implementations of the software include the manufacturer’s trade and professional secrets. The User therefore does not have a right to study the software for the purpose of determining its structure or technical implementations, unless otherwise specified in mandatory legislation.

The User may not use the Service for (i) any unlawful, inappropriate, or unintended purpose; (ii) activities that are intended to interrupt the operation of the Service, make it difficult for other users to use the Service or otherwise interfere with the operation of the Service; (iii) any other form of misrepresentation.

Sähkölaitos shall not grant the User any rights to the Service other than those specifically mentioned in these Terms of Use. The User shall release Tampereen Sähkölaitos and all its representatives, managers and employees from liability related to all claims arising from the User’s use of the Service.

The User’s responsibilities

The User shall be responsible for the accuracy of the information provided for the Service, for the receipt of the information and for ensuring the User's right to provide such information. The User must also strive to ensure that the material submitted does not contain malware or other harmful content.

The User shall be responsible for ensuring that the username and password related to the Service are not disclosed to third parties. The User shall be responsible for the use of his or her username and password and for any damages caused by it. The User is obliged to notify Tampereen Sähkölaitos of the loss of his or her username or password or their disclosure to a third party. The notification shall be made by e-mail to asiakaspalvelu@sahkolaitos.fi. The user shall receive a new username and password to replace the lost ones upon request.

By logging in to the Service, the User accepts that Tampereen Sähkölaitos may choose not to send a hard-copy annual report describing energy consumption. The corresponding information is available in the Service. However, Tampereen Sähkölaitos may also choose to send a report to those who have logged in to the Service.

Intellectual property and other immaterial rights

The Service and Content are the property of Tampereen Sähkölaitos or its partners and are protected by related intellectual property rights, such as copyright laws and international copyright agreements. All intellectual property rights related to the Service and Content (such as copyrights, registered and unregistered trademark and design rights, domain names, patents, database rights and trade secrets) are the property of Tampereen Sähkölaitos or its partners or parties otherwise presented in the Service. Using the Service does not grant the User any intellectual property or other rights to the Service or any data or Content in the Service. All rights reserved.

Tampereen Sähkölaitos has a free and unrestricted right to use, modify, transfer, copy, store, publish and otherwise utilise all materials provided by the User to the Service in all its operations.

Paid Services

By default, the electronic Services provided by Tampereen Sähkölaitos are free of charge for Users. If any of the Services is subject to a fee, this will be stated prior to registration to said service. Using and registering to paid Services requires a minimum age of 18 years and, for minors, the consent of a guardian or trustee. The deployment of paid Services requires payment of the fee specified for the Service. A separate subscription fee may also be charged for a paid Service, as well as a fee that is based on the use of the Service, time-based or otherwise determined.

Tampereen Sähkölaitos may change the price and pricing criteria of the Service or a part thereof if necessary. The currently valid prices and pricing criteria are always listed on the Service's website. Tampereen Sähkölaitos shall inform the User of any changes in an appropriate manner.

The User is obliged to make the payment for a paid Service in the manner specified for the Service, on an electricity bill or through online banking, for example. The invoice must be paid no later than the due date. Delayed payments are subject to penalty interest starting from the due date in accordance with the Interest Act. Tampereen Sähkölaitos shall charge a reminder fee in accordance with the price list to cover the costs incurred in processing the payment request.

Tampereen Sähkölaitos may block the User's access to the Service if payment has been delayed and is not made within two (2) weeks of sending the payment notice. Tampereen Sähkölaitos may charge a reasonable fee for reopening the Service.

Tampereen Sähkölaitos has a right to check the User's credit information before registering for a paid Service. Tampereen Sähkölaitos has a right to deny the User the use of a paid Service if a credit check reveals that the User has a bad credit history or if there is another justified reason for blocking the use. The User has a right to be informed of the grounds for denying the use of the Service upon separate request.

Limitation of Liability

The Service is intended as a value-added service for Users, and Tampereen Sähkölaitos shall not be responsible for the accuracy, completeness or reliability of the Service.

Tampereen Sähkölaitos shall not be liable for any direct or indirect damages related to the Service.

Tampereen Sähkölaitos shall in no way be responsible for any service or content provided by another service provider or their related intellectual property rights, even if the service can be accessed through the Service provided by Tampereen Sähkölaitos, such as through a link or otherwise. Tampereen Sähkölaitos shall not be responsible for any views or opinions expressed at any discussion forums or similar platforms that may be used in the Service.

The information, instructions or advice in the Service are in no way intended to be legally, commercially or otherwise binding, and the User may not invoke them or make any claims against Tampereen Sähkölaitos.

The aforementioned limitations of liability cover, among other things, all damages resulting from potential disruptions, delays, errors, incomplete or ambiguous information, obstruction of use, malfunction of user IDs or any other issues related to the use or functionality of the Service. Tampereen Sähkölaitos shall also not be responsible for any loss or damage that may be caused by information system or data communication malfunctions or errors or malware, and shall not be responsible in any way for any third-party site or material the Service may contain a link or reference to.

Personal information and data security

Tampereen Sähkölaitos complies with currently valid data protection legislation. Data stored in the personal registers shall be used only for the purposes stated in the register. Privacy policies and more detailed information on data protection policies in force are available at www.sahkolaitos.fi/tietosuoja.

Tampereen Sähkölaitos may send the User information related to direct marketing about its products and services, if the User has consented to this during registration. In addition, Tampereen Sähkölaitos may, with the User’s consent, disclose information provided by the User in the Service to third parties for targeted direct marketing. By law, the User has a right to prohibit the processing of his or her personal data for direct advertising, distance marketing or other direct marketing. The User also has a right to inspect the personal data stored about him or her and to have inaccurate, unnecessary, incomplete or outdated personal data corrected or deleted. The User is aware that the online environment and online services as such are never completely secure. The User shall be responsible for the proper management of the security of his or her own information systems and network connections.

Tampereen Sähkölaitos will keep all information concerning or sent by the User confidential. Tampereen Sähkölaitos organizes the information security of its Service efficiently and in a generally acceptable manner and strives to prevent unauthorised access to its information systems using appropriate technical and organisational solutions.

Validity and changes to the Terms of Use

These Terms of Use shall become binding on the User once they have been accepted by the User. Starting to use the service is also considered to be an explicit acceptance of the Terms of Use. The Terms of Use shall become binding on Tampereen Sähkölaitos after Tampereen Sähkölaitos has approved the User's registration in the Service.

The Terms of Use are valid until further notice. Either party may terminate the Terms of Use at any time with immediate effect. Tampereen Sähkölaitos may change the Terms of Use at any time by notifying the User. If the User does not accept the change, the User may terminate the Terms of Use. Upon termination, the User's right to use the Service expires immediately.

Tampereen Sähkölaitos may modify the Service, discontinue the Service, block access to the Service or revoke the right to use the Service at any time without prior notice (e.g. upon termination of the User's customer relationship). Permanent blocking of access to the service / termination of the right of use is automatically considered to be a termination of these Terms of Use by Tampereen Sähkölaitos.

Tampereen Sähkölaitos has the right to delete a user ID that has been unused for more than 12 months as well as information related to this ID from the Service.

The validity of paid Services and their terms of termination shall be agreed separately.

Applicable law and jurisdiction

The laws of Finland shall apply to these Terms of Use. Disputes shall be resolved in the Pirkanmaa District Court.

Transfer of rights and obligations

The User does not have a right to transfer the right to use the Service or any agreement concerning the Service to a third party. Tampereen Sähkölaitos has a right to transfer the Service or its maintenance and related responsibilities and obligations as well as any agreement concerning the Service to another company that is part of the same group, or if Tampereen Sähkölaitos or its business is transferred to another company as a result of a transaction, transfer, merger or division or a comparable corporate reorganisation.
